Appeal an NEC decision on a Development Permit Application

Once the Niagara Escarpment Commission has made a decision regarding a development permit application, a Notice of Decision is sent to the permit applicant, other agencies consulted during the application assessment stage, and neighbouring landowners within 120 metres of the subject property. The Notice of Decision provides: 

  • a description of the proposal 
  • the conditions of approval or the reasons for refusal.  

After a Notice of Decision is made, anyone who receives a copy of the Notice of Decision may appeal to the Minister of Natural Resources and Forestry in writing within 14 days. 

You must fill out and complete an appeal form and submit to the Niagara Escarpment Commission within the 14 day notice period by:

Upon receipt by the Niagara Escarpment Commission, an appeal is forwarded to the Ontario Land Tribunal that appoints a Hearing Officer to process the appeal. The Hearing Officer will make a report to the Minister of Natural Resources and Forestry within 30 days after the conclusion of the Hearing or within such longer period as Minister may permit.
